Emergency Lighting Testing: What UK Businesses Must Do

The law says maintain it but never says how often. Here's where the monthly and annual tests actually come from, who carries the duty, and what inspectors check.

Emergency lighting needs a short functional test every month and a full-duration test once a year, with both recorded in a log book. That is the answer most people are looking for. What surprises them is that no law says it.

The fire safety legislation tells you to maintain the system. It does not set a frequency. The monthly and annual regime comes from the British Standard, and understanding that distinction is the difference between ticking a box and actually being able to defend your position if something goes wrong.

Where the legal duty comes from

In England and Wales, non-domestic premises fall under the Regulatory Reform (Fire Safety) Order 2005. Two articles matter here.

Article 14 covers escape routes. It states that "emergency routes and exits requiring illumination must be provided with emergency lighting of adequate intensity in the case of failure of their normal lighting". That is the requirement to have it in the first place.

Article 17 covers maintenance. It requires that such equipment is "subject to a suitable system of maintenance and are maintained in an efficient state, in efficient working order and in good repair".

Read those again and notice what is missing. No interval. No test procedure. No mention of a log book. The Order sets an outcome, that the system works when it is needed, and leaves you to demonstrate how you achieve it.

That is deliberate, and it is why "we test it sometimes" is not a defence. You are expected to have a system, and the recognised way of showing you have one is to follow the British Standard.

Where the monthly and annual tests come from

BS 5266-1 is the code of practice for emergency lighting in premises. It sets out the testing regime that everybody in the trade works to:

  • Monthly: a short functional test. Simulate a mains failure long enough to confirm every luminaire and exit sign illuminates. Keep it brief, because the batteries then need time to recover.
  • Annually: a full rated duration test. Usually three hours, which is what most UK commercial systems are designed for. Every fitting must stay lit for the whole period and still be adequately bright at the end of it.
  • Throughout: record everything in a log book, including failures and what was done about them.

Following a recognised standard is how you show your maintenance system is "suitable". Departing from it is possible, but then the burden is on you to justify what you did instead.

The annual test detail nobody plans for

After a three-hour discharge, the batteries are flat. Depending on the system, they can take up to 24 hours to recharge fully. For that entire window, your emergency lighting is not going to give you three hours if the power goes.

Which means the annual test is not something to run the afternoon before your busiest trading day, or the night before an event. Schedule it when the building is quiet and there is a clear day afterwards for the batteries to recover.

It also means splitting the test across the building in sections is often the sensible approach in larger premises, so you never have the whole site at reduced protection at once. That is a conversation to have with whoever does the testing rather than something to discover afterwards.

Who is actually responsible

The Order puts the duty on the "responsible person". In a workplace that is the employer, if the premises are under their control. Otherwise it is the person with control of the premises, which can be the occupier, the owner, or a managing agent, depending on the lease.

This is where multi-tenanted buildings get messy. The landlord may maintain the emergency lighting in the common parts while each tenant is responsible for their own demise. The lease usually decides it, and plenty of leases are vague. If you have taken a unit and nobody has ever mentioned emergency lighting testing to you, that is worth resolving in writing rather than assuming somebody else has it covered.

The government's own summary of workplace fire safety responsibilities is a reasonable starting point if you are unsure whether the duty sits with you.

What gets checked, and what usually fails

From doing these across London offices, shops and restaurants, the failures repeat:

  • Dead batteries. The most common by far. A fitting whose LED charge indicator is lit is telling you it is receiving power, not that its battery holds three hours. Only a duration test proves that.
  • Fittings that pass the monthly and fail at ninety minutes. Exactly why the annual test exists. A battery at the end of its life will happily light a lamp for thirty seconds.
  • Coverage gaps after a refit. Someone moves a partition, adds an office, changes the escape route, and nobody revisits the lighting design. The old layout was compliant. The new one has a dark corner at a turn in the corridor.
  • Exit signs pointing the wrong way, again usually after a layout change.
  • Missing or fictional log books. A log with twelve identical monthly entries all in the same pen is worse than no log at all.
  • Maintained and non-maintained fittings confused. A maintained fitting is lit all the time, a non-maintained one only on failure. Swapping one for the other during a lamp change quietly changes what the system does.

How this fits with your other electrical duties

Emergency lighting testing is separate from your fixed wiring inspection, and separate again from appliance testing. They get confused constantly.

  • Emergency lighting: monthly function test, annual duration test, to BS 5266-1.

An insurer or a fire officer asking for "your electrical certificates" generally wants to see all of them, and the gaps show up fast when they are laid side by side.

Getting a system you can actually maintain

If you have inherited a building with no records, the honest starting point is a survey rather than a test. There is no point testing fittings monthly if the coverage was never right, or if half the units are twenty years old and the batteries are all going to fail in the same quarter.

A survey tells you what is installed, whether it covers the current escape routes, and what condition the batteries are in. From there the monthly and annual routine is straightforward and cheap to keep up.

Self-test fittings are worth considering for anywhere with a lot of luminaires or awkward access. They run their own function and duration tests and flag failures, which removes most of the labour and all of the temptation to fill the log in from memory.

Someone competent to do it, which means the knowledge and equipment to carry out the test and interpret the result. A monthly function test can often be done by a trained member of staff using the test key or switch. The annual duration test and any certification is a job for a qualified electrical contractor.

How long must emergency lighting stay on?

Three hours is the standard duration for most UK commercial premises. One hour is permitted in limited circumstances where the building will be evacuated immediately and not reoccupied until the supply is restored. Your fire risk assessment should say which applies to you.

What happens if we have not been testing it?

Start now, and be honest in the log about when the record begins. A fire officer would far rather see a system that was surveyed, brought up to standard and logged properly from a known date than a book of invented entries. Falsified records make a bad situation considerably worse.

Do we need emergency lighting in a small shop?

It depends on the escape routes rather than the floor area. If any part of the route to a final exit would be unsafe in the dark, or the premises has no borrowed light from the street, it will be needed. Your fire risk assessment is what decides it, and if you do not have one, that is the more urgent gap.
